Understanding Bail and How to Get Released

Money or property given to the court as a guarantee that the defendant will appear for future court dates. If the defendant appears, bail is returned; if not, it is forfeited.

Understanding Bail

Bail amounts are set based on the severity of charges, flight risk, and public safety concerns. Bail bonds allow defendants to pay a percentage (typically 10%) to a bondsman who posts the full amount. Some defendants are released on their own recognizance without bail.

Examples

  • 1$10,000 bail requiring $1,000 to bondsman
  • 2Release on own recognizance for minor charges
  • 3Bail denied due to flight risk or danger to community
