What is Respondeat Superior?
A legal doctrine that holds an employer vicariously liable for the negligent actions of an employee when those actions occur within the scope of employment.
Understanding Respondeat Superior
Under respondeat superior, if a delivery driver causes an accident while making deliveries, the employer can be held liable for the resulting injuries. The key question is whether the employee was acting within the scope of their employment at the time of the incident. Actions taken for personal reasons or outside work duties generally fall outside the doctrine.
